Thank you to the jury for returning for a second day of testimony in this trial. Your time is appreciated." Donnelly Harriman nods to the jury. Walt Zanderbilt nods. Nadli Clu'sa nods to Donnelly Harriman. Waverly Chow nods. Donnelly Harriman says, "The second phase taking place today is the taking of evidence, and this is the time at which witnesses will give their testimony answering questions put to them by the Crown and the Defense. It is also the time in which the physical evidence will be offered in the course of testimony as exhibits." Jewel Michaels nods. Portia Bailey glances at Jesse Jones. Tony Malone turns off his communicator. Donnelly Harriman says, "I will remind everyone in the courtroom to please extend your courtesy to those testifying and to the jury, and remain as still as possible." Nadli Clu'sa pays close attention. Donnelly Harriman says, "I will deal harshly with those who detract from the trial." Donnelly Harriman says, "The rules of evidence govern what can be heard and considered in trial, and these rules are applied by me as the judge in the case. There will be disputes about what can be heard and considered. It is the professional obligation of counsel to raise objections. " Donnelly Harriman glances at the jury. Donnelly Harriman says, "Don't think that when an objection is made that it has any significance for you until it's ruled on. Sometimes I will sustain the objection, then the witness will not answer the question and you disregard the question as well." Ami Stuart nods. Donnelly Harriman says, "If an objection is overruled, that, of course, means that I disagree with a particular objection, but that again does not give any particular significance to the answer." Ryan Sloan nods. Donnelly Harriman says, "You should consider that answer in the same way as you do any other part of the witnesses' testimony, even though an objection was made and overruled." Walt Zanderbilt nods. Donnelly Harriman says, "Don't hold it against counsel for raising an objection. It's their professional obligation to do that, and there can be times when that can get somewhat heated. It's part of why I am here, to rule on these matters." Donnelly Harriman smiles. Nadli Clu'sa crosses her legs. Donnelly Harriman asks, "Who is your first witness?" Portia Bailey says, "Your Honor, Ladies and Gentlemen of the jury, the Crown calls Detective Chavez." Donnelly Harriman nods. Terrisa Chavez stands back up. Donnelly Harriman asks, "Thank you. Would you please step forward and raise your right hand to be sworn in?" Terrisa Chavez approaches the bench and raises her right hand. Donnelly Harriman asks, "Do you swear to tell the truth, the whole truth, and nothing but the truth about the matters involved in this trial?" Terrisa Chavez says, "I do." Donnelly Harriman says, "Thank you. You may be seated. Ms. Bailey, your witness." Terrisa Chavez sits down. Portia Bailey asks, "Detective, you have been in charge of this case for the Police Department, is that right?" Terrisa Chavez says, "Yes, ma'am." Portia Bailey asks, "And you have collected and catalogued all the Physical Evidence the Crown will introduce in this case, correct?" Terrisa Chavez says, "Yes, that is correct." Terrisa Chavez nods to Portia Bailey. Gregory Townsend exclaims, "Objection, your Honor!" Terrisa Chavez blinks. Gregory Townsend says, "Counsel is leading the witness." Portia Bailey says, "Detective, tell us about the locations where you found these items, please." Terrisa Chavez gets a spiral notepad from inside her leather briefcase. Terrisa Chavez opens a spiral notepad. Portia Bailey says, "Please tell us the relevance of the evidence, as well." Terrisa Chavez nods. Terrisa Chavez says, "The physical evidence collected in this case came from three sources and/or locations -- The Board of Governors' Room in Town Hall just after the bombing on 28 September 2000; Chandler Ghent's offices located at 43B Jacaranda Way, Cape Marassas; and from Witness for the Prosecution, Tony Malone." Terrisa Chavez says, "Please allow me to verbally reconstruct how the evidence is linked." Portia Bailey nods to Terrisa Chavez. Terrisa Chavez glances at the Councils for the Defense then up at the Magistrate. You see Tony Malone. He appears to be in his early twenties. He stands 5 feet and 11 inches tall and has an average build. He has dark skin, frizzled short brown hair, and brown eyes. He is clean shaven. Tony seems to be in a nervous mood. He looks perfectly healthy! Tony Malone is wearing a pair of leather dress shoes, a pair of textured-wool slacks, a black CMPD flak vest, a jet black PBR communicator, and a dark wool suit. Terrisa Chavez says, "On 28 September 2000, as per the deposition of Mr. Malone, a glass vase fitted with a radio detonation device, and packed with the plastique explosive commonly referred to as 'C4' was substituted for the usual floral arrangement. This device was placed in the Board of Governors' meeting room in Town Hall on the central table." Terrisa Chavez has a tight look on her face. Terrisa Chavez says, "The regular security sweep of the room did not generally check the floral arrangements, and the device went unnoticed." Terrisa Chavez says, "Sampling of the remains of the wooden table showed the melted fragments of the vase, and lab work on the fragments showed that they were consistent with what would have been a glass piece used as the container for the explosives." Terrisa Chavez says, "The samples of the residue taken from the walls of that crime scene came back positive as having been made by a nitrated substance, more specifically C4, plastique explosive. The lab believes the amount used was in the range of 5.5 to 7.5 pounds, which is consistent with the deposition made by Mr. Malone." Terrisa Chavez says, "Plastique explosives can be 'cooked' from a variety of 'recipes'. The C4 found in Chandler Ghent's locked desk in his office was consistent with the composition of the residue taken from the scene of the bombing." Terrisa Chavez flips a page in her notebook. Terrisa Chavez says, "A fragment of wire, also found at the scene of the bombing, was believed to have been the antenna for the radio receiver of the detonation device. In order to work, the antenna would have had to be set up with a highly specialized filter so only the correct frequency made it through. This highly selective filter also 'received' a signal generally blocked by the the room's shielding. These filters are extremely expensive, though available on the open market. The lab feels that the explosion wou" Walt Zanderbilt gets a distant look on his face as he ponders. Terrisa Chavez says, "Feels that the explosion would have deconstructed or destroyed the receiver, as these pieces are usually fairly delicate." Nadli Clu'sa gets a distant look on her face as she ponders. Terrisa Chavez says, "Lab tests on the wire revealed it to be standard 10 gauge copper household grade, insulated, at least partially, with a PVC plastic coating. Identical wire was found on the premises of 43B Jacaranda Way, the Ghent offices." Terrisa Chavez looks up from her notes. "Shall I continue?" Portia Bailey nods to Terrisa Chavez. Portia Bailey says, "Yes, please do." Terrisa Chavez nods to Portia Bailey. Terrisa Chavez says, "Moving to the physical evidence garnered from witness, Tony Malone ..." Terrisa Chavez says, "Mr. Malone gave into police custody a device. It is the transmitter which was used to activate the bomb in Town Hall." Terrisa Chavez says, "The transmitter itself is a fairly sleek, if simple device, made to send out a specific, single, high-end signal. Inside the device the transistor is visible and the word "Belgium" is stamped in white, raised lettering. Removing other components of the system allows the full stamp to be seen: "Velleman Belgium"; indicating the manufacturer and the country of origin." Terrisa Chavez says, "In the premises previously stated as the Ghent offices, a matching transistor was found. It lay underneath Chandler Ghent's desk in his private office, resting at a cocked angle on the carpet. It is this investigator's belief that it had fallen off the edge of the desk and bounced, unknown, out of sight of the room's occupants." Terrisa Chavez says, "This transistor also bears the words, "Velleman Belgium" in white raised lettering -- identical in make as the transistor in the detonator supplied by Mr. Malone." Terrisa Chavez flips to the next page in her notebook. Terrisa Chavez says, "Wires taken from the detonator were shown to be household grade 18 gauge PVC-coated copper. This type of wire is most commonly used for small electronics. Country of origin for this specific wire is the USA. " Terrisa Chavez says, "A spool of wire was removed from the 43B Jacaranda. The lab found a 100% match with the previously sampled wire -- household grade 18 gauge PVC-coated copper manufactured in the USA." Terrisa Chavez glances again briefly at the Councils for the Defense before continuing. Portia Bailey glances at Chandler Ghent. Terrisa Chavez says, "The last piece of physical evidence is a lot of nine pens. Written testimony given by Delphine Courtney, the Steward's secretary, identifies these pens as being property of the Town Hall and were last seen by Miss Courtney in the Board of Governors' meeting room on the table the afternoon of 28 September. Miss Courtney states that the pens are specially ordered from France, and it takes several weeks for an order to be filled if one strays or is damaged." Chandler Ghent glances at Portia Bailey. Portia Bailey nods to Terrisa Chavez. Terrisa Chavez says, "All nine pens were found on the premises of 43B Jacaranda Way, the Ghent offices, on 30 September." Terrisa Chavez clears her throat. Terrisa Chavez says, "This concludes the review of the chain of physical evidence in this case." Terrisa Chavez closes a spiral notepad. Portia Bailey says, "Thank you detective." Portia Bailey says, "Now, just to make sure we have this right..." Walt Zanderbilt blinks. Portia Bailey asks, "You found pieces to make a bomb like the one that killed 6 people in the office of the defendant?" Terrisa Chavez says, "I found components which could be used to fabricate a bomb in the office Mr. Ghent. Yes." Portia Bailey asks, "And the transmitter you found is rare on this island, is it?" Terrisa Chavez says, "Some of the components are very difficult to find on Morada." Portia Bailey nods to Terrisa Chavez. Portia Bailey asks, "Detective, how well do you know the defendant?" Terrisa Chavez furrows her brow. Terrisa Chavez says, "I only know him from investigation into his activities on the island." Portia Bailey asks, "Do you know if he commonly keeps bomb making paraphenalia in his place of business?" Terrisa Chavez says, "I know that in his prior place of business certain flamables and incindiaries were kept." Portia Bailey nods to Terrisa Chavez. Terrisa Chavez says, "I'm not acquainted with what he regularly stored in the Jacaranda locale." Nadli Clu'sa arches an eyebrow. Walt Zanderbilt blinks. Nadli Clu'sa glances at the defense attorney. Portia Bailey asks, "And the ingredients for the explosive C4, are those ingredients legal to own on Morada?" Terrisa Chavez says, "No. C4 is considered an illegal material on the island." Portia Bailey nods to Terrisa Chavez. Portia Bailey asks, "Has the Police Department ever confiscated C4 on this island before?" Terrisa Chavez says, "Not while I have been in residence." Portia Bailey asks, "Has your department ever confiscated a device like this transmitter before?" Terrisa Chavez says, "No, ma'am." Nadli Clu'sa frowns. Portia Bailey says, "Thank you, Detective. Terrisa Chavez says, "The first was an explosive device allegedly thrown by Chandler Ghent at a crowded street corner." Terrisa Chavez says, "The other was a boobytraped ring given to a tourist, Mr. Mark Grant." Donnelly Harriman says, "Objection overruled, Ms. Bailey. The Defense may continue." Mark Grant glares at Chandler Ghent. Winston Chapel asks, "Would you consider yourself an expert in explosives based on these cases, Ms. Chavez?" Chandler Ghent glances at the uncontrolled form of Mark Grant and coughs as if to say, "Behave yourself." Terrisa Chavez says, "I am not a demolitions expert, though I have general police background in such matters." Winston Chapel asks, "How long have you been Detective Chief Inspector?" Walt Zanderbilt gets a distant look on his face as he ponders. Terrisa Chavez says, "Since Adam Blackburn retired from the CMPD." Winston Chapel asks, "Would you say less than a year?" Terrisa Chavez says, "Definitely less than a year." Winston Chapel asks, "How many high profile arrests have you made since you have been Detective Chief Inspector?" Winston Chapel asks, "Is this office considered a public or private place of business?" Terrisa Chavez says, "I don't know. You'd have to address that to Mr. Ghent." Winston Chapel nods. Winston Chapel asks, "Was the evidence you found in this unlocked office tested for fingerprints?" Terrisa Chavez says, "Yes, it was." Winston Chapel asks, "And Mr. Ghent's fingerprints were no where on this evidence?" Terrisa Chavez says, "No, Mr. Ghent's fingerprints were not found on the evidence collected." Portia Bailey exclaims, "Objection! Leading!" Portia Bailey stands back up. Gregory Townsend sighs. Winston Chapel says, "Leading is allowed on cross, Your Honor." Winston Chapel nods. Winston Chapel asks, "To your knowledge does Mr. Ghent have any other offices on the island?" Donnelly Harriman nods to Winston Chapel. Nadli Clu'sa glances at Portia Bailey. Terrisa Chavez says, "For a series of violations against building and safety code." Winston Chapel asks, "Was this Trench office searched for evidence?" Walt Zanderbilt blinks. Terrisa Chavez says, "It was searched for evidence pertinent to this case, yes." Winston Chapel asks, "Was any evidence found there relevant to this case?"
