John Berryman of Lancaster Co, VA
This John Berryman was born June 23, 1742 and was the great grandson of Benjamin Berryman and his first wife, Sarah Butler.

John's parents were Gilson Berryman and Hannah Berryman. Hannah was the daughter of Benjamin Berryman, jr. and Sarah Bushrod. Gilson was the son of (the below) John & Behethland Berryman.

John's grandparents were John Berryman (Benjamin's first son named John) and Behethland Gilson. Behethland was the stepdaughter of Benjamin's second wife, Elizabeth Newton, by her first marriage to Thomas Gilson.

Note: Gilson was/is pronounced "Jill-son" per Gilson Gray Berryman of Bronxville, NY (from Bob Clark)

John Berryman's guardian was Willoughby Newton and his wife Sarah Eskridge. This John Berryman married, first Martha Newton of Westmoreland Co, ca. 1761 (daughter of Willoughby & Sarah), and second Sarah Brent of Lancaster Co, ca. 1776.
I believe he is the John Berryman who signed the Leedstown Resolves (Stamp Act). Several of his in-laws, the Brents, also signed.
He was a Capt. in the Rev. War, a Representative in the Virginia House of delegates and a Sheriff of Lancaster Co. ca. 1782-1786.

Packet found among the papers of Hon. Richard Hickman Prewitt, Lawyer of Lexington Kentucky, born 1833, died in 1888.

1. 24 November, 1664, Westmoreland County, Virginia. Certified (this word is crossed-out and a hand-written Attached is written in it's place) copy of grant from Sir William Berkeley to Thomas Dios [Dies, Dyess? MB] for "Five hundred acres of land being in Westmoreland County on the south side of Potomack River buthing on the north east side towards the head of Quantiko Creek ..."
[MB note: This may have been the land where Benjamin Berryman jr. was living when he died in 1748.]

2. 2 April, 1697, recorded 10 August 1698. Stafford County. Attested by "V. Peyton C.S.C." Will of Andrew Gilson.
[MB Note: Andrew Gilson and his wife Beheathland [Bernard?] were the parents of Thomas Gilson. Thomas Gilson's "only daughter" was Behethland Gilson. This daughter, Behethland Gilson, married John Berryman, see # 4.]

3. 8 May, 1707. Stafford County. Inventory of the estate of Thomas Gilson, recorded 14 May, 1707.
[MB Note: Thomas Gilson's last wife was Elizabeth Newton the only daughter of John Newton and his 4th wife, Rose (nee?) Tucker Gerrard Newton. Elizabeth Newton married second, Benjamin Berryman sr.]

4. 21 August, 1720, recorded February 13, 1722, Stafford County, last will and testament of John Berryman.
[MB Note: John was Benjamin and his first wife, Sarah Butler Berryman's son and the first of two sons with the name John. There was a court case involving John's will. It pertained to his not having changed it after the birth of Gilson. Gilson won vs. his stepfather Thomas Booth (who married Behethland Gilson Berryman). The case was Berryman vs Booth (I've used circumstantial evidence to identify the parties in the court case since only last names are used in Bardahal's)]

5. 13 February, 1722, Stafford County, deed of gift from Behethland Berryman to her son Gilson Berryman.
[MB Note: A daughter of Thomas Gilson (probably by his 1st wife) she married the first John Berryman mentioned in # 4. I believe John and Behethland lived on Thomas Gilson's property which was on the northern shore of Upper Machodoc Creek near it's mouth. This land was in Stafford County until the "final reshaping" of the boundaries of King George, Stafford & Westmoreland Counties.]

6. 20 November, 1722, Stafford County, deed of slaves from Behethland Berryman to Benjamin Berryman.
[MB Note: These were probably slaves inherited from her father Thomas Gilson, unless some were a wedding gift from Benjamin Berryman. The slaves were named in the deed, but I have not been able to acquire a full copy.]

7. 28 July, 1748, recorded 12 June, 1750, Stafford County, will of Gilson Berryman.
[MB Note: He was the only child of John and Behethland Gilson Berryman, see # 4. Gilson married Hannah Berryman, the only child of his uncle, Benjamin Berryman jr. and his wife Sarah Bushrod. Gilson and Hannah were probably living on his grandfather Thomas Gilson's Stafford County land, see # 5.]

8. 30 April, 1775, Stafford County. "Indenture tripartite". John Berryman of Lancaster County and Martha his wife, Nehemiah [Richard,?] Blackstone Mason and Sarah his wife, and Daniel McCarty of Westmoreland County. Also names of Robert Washington and Townsend Dade.
[MB Note: This John Berryman was the 1st child of Gilson Berryman and Hannah Berryman. Gilson's other children were Behethland Gilson Berryman and Andrew Gilson Berryman by Hannah Berryman and Rose Berryman by Gilson's second wife Sarah Taliaferro. Sarah was the daughter of Rose Berryman and Richard Taliaferro]

9. 16 February, 1786, Lancaster County. Will of John Berryman.
[MB Note: This John was the son of Gilson Berryman & Hannah Berryman. He was sheriff of Lancaster Co, VA at the time of his death.]

10. 12 August, 1790, Lancaster County. Deed from Robert Clark Jacob of North Hampton (sic) County to John Haggaman of North Hampton County.

11. 10 November, 1798. Bill of sale for one negro girl from Richard Lancaster of Orange County to Gilson Berryman of Spotsylvania County.
[MB Note: This Gilson Berryman was the second son with the same name by John and Martha Newton Berryman. The first son, Gilson Newton Berryman, was b. March 28, 1762 in Stafford Co, VA and is listed at St. Paul's church. This second Gilson was born June 24, 1773 and is the Gilson who died in Fayette Co., KY.]

12. 15 August, 1808. Scott County, KY. Indenture from Gilson Berryman of Scott County, Ky. and Sarah Berryman of same county.
[MB Note: This is the # 11 Gilson, and (I believe) this Sarah Berryman was the wife of Benjamin Berryman (son of William & Rebecca). Gilson's stepmother Sarah Brent Berryman, John Berryman's 2nd wife, died in Cople Parish, Westmoreland Co, VA in 1819. Her will was written March 4, 1819 and witnessed by Francis Self and Catherine (X) Ennes (Ennis?). She mentions the children of her deceased son, Richard Berryman of KY. At her death, she was probably living with her son-in-law George Glascock, sr.]

13. 8 March, 1808. Agreement between John Berryman and Wm. Monroe both of Scott County, Ky.
[MB Note: Not sure which John this is. William & Rebecca's son Francis married Elizabeth Newton Barr Mar 8, 1786 in Fauquier Co, VA and was the Frank mentioned in Gerrard B. Berryman's 1838 letter. This John Berryman may have been their son. John Monroe married Winifred Berryman daughter of William & Rebecca Berryman; the above, William Monroe was probably their son.]

14. 10 April, 1815. Lancaster County, Virginia. Judgment of the Superior Court of Law. "In suit of John Hunt against Richard Berryman for slander".
[MB Note: This Richard Berryman was the younger half-brother of Gilson Berryman by John & Sarah Brent Berryman.]

15. 10 April, 1815. Lancaster County, Virginia. Appears to be an execution on the aforesaid judgment.

16. 5 April, 1820. Fayette County, Ky. Inventory of the estate of Richard and Ann S. Berryman, his wife both deceased. Richard married Ann Steptoe of Lancaster Co.

17. 14 May, 1821. Receipt from Thomas Wallace to Gilson Berryman.

18. 24 June, 1828. Letter to Gilson Berryman and James P. Ellis of Lexington, Kentucky, from Jno. Meridith of Kilmarnock, Virginia.

It appears from this letter that the legal question concerns items 5 and 8 above listed as the property was entailed, and John Berryman's authority to convey was questioned.

In the name of God Amen. I John Berryman of the county of Lancaster being sick and weak but of perfect senses and memory Thanks be to God for the Same, Do make this my last Will and Testament in manner and form following. --
Imprimis . . .
I give my soul to Almighty God who gave it me, hoping for full pardon for all my sins through the merits of my ever blessed Savior and Redeemer Jesus Christ, hoping for full and ample mercy at the Throne of Grace through his death and passion; and my body to the earth from whence it was taken to be decently interred by the Side of my deceased wife in a plain flat coffin, with as little ceremony as possible in the company of my friends and neighbors who choose to attend. . .

I give and --- bequeath and devise all my Land in Lancaster County to my two sons Gilson and Richard Berryman to them and their heirs forever, to be equally divided between them by my executors hereafter named or persons appointed by my said sons, and after the Division my son Gilson to have his choice and should either of my Said Sons Die before he comes of age or has a lawful child or children, then I give his part to my youngest Son James to him and his heirs forever, and if both my sons Gilson and Richard should die before they come of age or have a lawful child or children, then I give all my Said Land to my Son James to him and his heirs forever, and should he die before he comes of age or has a lawful child or children, then I give my said Land to my daughters Sarah Foote, Martha and Frances Bushrod to them and their heirs forever and if my daughters Sarah Foote and Martha or either of them should die before they come of age or have a lawful child or children then I give my Said Land to my daughter Frances Bushrod and the Survivor of my other two daughters to them and their heirs forever, and in case my youngest daughter Frances Bushrod should die before she comes of age or has a lawful child or children then I give my said Land to my other two daughters or the Survivor of them to them and their heirs forever. --

It is my wish that all my Negroes be equally divided among all my children or the survivors of them including my wife's thirds and that half blood may not be a bar to their inheirtance each from the other, but my Negroes to descend in the same manner as if they were all my children by one mother, that if one or more of my children should die, before him, her or them should come of age or have a lawful child or children then and in that case my will is that my Negroes be equally divided among the survivor or survivors and to their heirs forever.

My will is that as convenient as may be after my decease my executors hereafter named do see and consult the hble William Grayson, Esquire upon the bargain and agreement entered into by My self and the Said Grayson concerning my Land in Prince William County and that they insist on the Said Graysons immediately fulfilling his bargain in the amplest manner (duplicate of which bargain is now in my desk with the said Graysons bond) and also that the Land I sold to William Cass Esqr. of Dumfries be surveyed as soon as possible and his and my bargain be punctually fulfilled. And that all the residue of my land in the Said County of Prince Willian not disposed and now in dispute as soon as the -- is determined (which suits the Said Grayson by my Agreement is to carry on at his own expense) be sold to the best advantage and the money arising from such sales as also all the money due me from William Cass, Esqr by bond or otherwise and that may further be due to my estate by his and my Agreement and all other debts due me of what kind and nature soever, be applied towards the payment of my just debts, and the balance be it little or much I give to my son James to him and his heirs forever and in case my said son should die before he comes of age or have a lawful child or children or if the money is not spent upon his education which I empower my executors to do if they find it necessary, then my will is the said money be equally divided among my surviving children and their heirs in the same manner as I have bequeathed my Negroes. --

It is my will that my estate be kept together during my wifes Remaining my widow, and that she and my children be supported and maintained, and my children educates out of the profits of it, but as my children arrives at age or marries, my will is that if they do require, their part of my estate which I have or shall give them be immediately put in their possession, and if my wife should marry, my will is that her thirds be immediately laid off as the law directs, and that she have in that case a childs part of all my movables and Stock.--
Item:
My will is that my three sons as they grow up shall have a liberal education and that as soon as they have received such
education, they be put to Study the law or physic, and if the profits arising from the estate should not be sufficient for the expense necessarily attending such education, Study and their otherwise necessary suport, I empower and give full Authority to my executors hereafter named to dispose of any part or all of their equal part of my eastate which I have devised to them (if necessary) except my Land in Lancaster County, and apply it for the purposes aforesaid accounting with my said sons when they arrive at age and informing fully how and in what manner their estates has been disposed of and for what purposes. --

I give to my daughter Sarah Foote the Bristol Stone shoe buckles that belonged to her mother and her mothers wedding ring. --

It is my will that should my wife die leaving my children or any of them young and Mrs Frances Maxwell unmarried at the time of her decease, that the said Mrs Maxwell if she will take the trouble upon her self shall reside at my dwelling house during the minority of my son Gilson - (should he make choice of that part of my Land) and take care of my younger children, and be fugally Supported out of my estate during the time that my estate (as before directed) or any part of it is kept together for the support of my children, and she will take the trouble upon herself of taking care of them.--

It is my will that my dwelling house be well plastered and white washed as soon as possible at the expense of my estate. --
And lastly:
