Julián Bernal was a widower from his first marriage to doña María Mónica Provencio, and wished to marry doña Francisca Provencio, daughter of don Antonio Provencio and doña Vicenta Velarde, and carnal sister of don Julián's deceased wife, doña Mónica Provencioj, thus making the prospective bride and groom related in the first degree of affinity on a transverse line. When questioned, don Julián said that despite being related in the first degree on a transverse line to his intended, that in this area, all persons of his class and caste and social standing were relatives by affintiy or consanguinity, which would be attested to by his three witnesses. He added that María Francisca, whom he called esta niña, was with her widow mother, an honest person with a large family, and so poor that if he did not assist with sustenance in the same manner as if they were married, and actually in his type of widowerhood with having three small children in his home along with all the other family, that unless he marries another he will have no one to care for his family and to be in his company. The widow mother whom he was supporting with her family had five sons, one of whom was already married and living at least 80 leagues away, while the second son was the victim of an accident which incapcitated him such that he needed support rather than being able to contribute to the support of his family. The other boys were all under ten years old. Bernal gave a lengthy and heart-rendering account of the plight of the family, hoping to gain the sympathy of the priests so that he would be given a dispensation to marry despite his relationship in the worst degree possible, and for which despensations were almost never granted.. He went so far as to say if he left his bride-to-be's family, they might have to resort to begging and prostitution for support, for if he were to marry another, he would have to send them all away. His very long tale resulted in three petitions going until 1817 when the incomplete file ends. A dispensation had been refused until that time. Few DMs reads more like a soap opera than this one. A DM was held for Luis Carvajal and Rosa Armijo at El Paso from 26 Oct. 1775 to 27 Feb. 1776; the proceedings are recorded in AHAD-27, f. 116-20, (Hendricks & Colligan, "N.M. Prenuptial Investigations," p. 15-16), Luis Carbajal, 37, español, widower from his marriage to Gertrudis Lucero, son of Miguel Carvajal and María Padilla, natives and citizens of El Paso, and Rosa Armijo, 19, adopted daughter of Manuel Durán de Armijo and Teodora Maese, also natives and citizens of El Paso. Teodora Maese testified that Rosa was a blood relative of Luis as she was the natural daughter of Juan Pedro Carvajal, who was also Luis' first cousin. Teodora was said to have given birth to Rosa prior to her marriage, but denied this to her husband, saying that her Rosa's father was dead. Teodora added that no one in the land could verify whether Rosa was Juan Pedro's daughter, because at that time it was not discussed. Rosa Armijo stated that her mother had said that Luis Carvajal was a relative, but that she did not know to what degree.. When the proceedings were forwarded to Bishop Marcarulla at Durango he had the parish priest at Paso find out whether Manuel Armijo was ignorant of the relationship of Rosa to Luis, and if satisfied with the response that due to the distance from Durango, fray Gómez Terán could marry the couple 24 hours after reading the banns had been completed. When the priest asked 44 year-old Teodora Maese whether her husband knew of Rosa's relationship to Luis, she said that during the delays in the prenuptial proceedings, her husband had asked her how the couple was related and who was Rosa's father,. She said she told her husband that she did not know the father's surname, and that he was deceased. When Luis Carvajal was asked the same questions, he said that Manuel Durán de Armijo had married Teodora while she was breast-feeding Rosa, and as a result it was assumed by him and others living in the area that Manuel was Rosa's father. As a result, the priest recommended that the bishop grant a dispensation to marry to the couple.
