Your Personal Web Pages (PWP) can be as unique as you are. The more your Web pages reflect your interests and who you are, the more likely it is that others will enjoy looking at them and sharing them with others.
In addition to the Guidelines, we've put together some good things to know when creating and viewing PWP, as well as PWP copyright and credit information.
Guidelines
Your PWPs are subject to the Prodigy Internet Member Agreement, the Interactive Features Guidelines, and these PWP Guidelines (together, the Guidelines). You agree that all information, data, text, software, code, music, sound, photographs, graphics, video, messages, chat, files, or other materials ("Content"), whether publicly or privately transmitted or posted, is your sole responsibility. This means that you, and not Prodigy, are responsible for all Content. Prodigy does not control or screen any Content posted or transmitted in PWP sites, and, as such, does not guarantee the accuracy, integrity, or quality of PWP Content. Prodigy is not liable for any loss, claim or damages, or errors or omissions, related to or resulting from use or participation in PWP. Prodigy reserves the right to remove at any time, without notice, any PWP Content that violates these guidelines, or is deemed objectionable as determined by Prodigy, in Prodigy's sole discretion.
YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS PRODIGY COMMUNICATIONS L.P., ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS FROM ANY CLAIMS, AND EXPENSES, INCLUDING ATTORNEYS' FEES, ARISING OUT OF OR IN CONNECTION WITH: (I) ANY BREACH OF THE MEMBER AGREEMENT OR THESE GUIDELINS BY YOU, (II) YOUR USE OF THE PRODIGY INTERNET SERVICE, PERSONAL WEB PAGES, SOFTWARE PROVIDED BY THE COMPANY AND ITS SUPPLIERS, OR THE INTERNET; AND, (III) ANY IMPROPER OR ILLEGAL USE BY YOU OR ANYONE WHO USES YOUR ACCOUNT WITH YOUR DIRECT OR INDIRECT PERMISSION.
Under the Member Agreement, you have agreed not to use Prodigy Internet to send, or submit for public posting, any obscene, sexually explicit, or illegal material (including material the transmission of which violates any applicable law), or material which violates Internet standards or customs, or any material that is protected by copyright or trademark laws or is the property of third parties without the authority of the owner of such property.
Use of the PWP feature on Prodigy constitutes your acceptance of the Guidelines. Continued acceptance of the Guidelines is a condition of participation in the PWP feature and of Prodigy membership. Prodigy reserves the right and has absolute discretion to restrict or remove from its servers any content that violates any of the Guidelines or related policies, is otherwise objectionable or potentially infringing on any third party's rights, or that may violate of any laws.
Upon becoming aware of any possible violation by you of the Guidelines, third party rights or laws, Prodigy may immediately take corrective action, including, but not limited to
A warning
The removal or blocked access to your PWP
The suspension of PWP privileges or termination of your Prodigy membership.
It is Prodigy's policy to terminate repeat infringers. The above stated rights of action, however, do not obligate Prodigy to monitor or use editorial control over the Content contained on your PWP. Prodigy shall not be obligated to refund to you any fees paid in advance of such corrective action. Decisions of the Prodigy staff regarding violations of the Guidelines are final. Prodigy may refer potential illegal matters to proper authorities and will cooperate in the investigation of any suspected crime or civil wrong. To comply with applicable laws and lawful governmental requests, Prodigy may access and disclose any information it considers necessary or appropriate, including, without limitation, user profile information (i.e., name, e-mail address, etc.), IP addressing and traffic information, usage history, and content residing on Prodigy's servers and systems. Prodigy may also report any activity that it suspects violates any law or regulation to appropriate law enforcement officials, government agencies, or other appropriate third parties. To the extent any inconsistency exists between any terms of Prodigy's Privacy Policy and this section, Prodigy's right to disclose under this section will control.
Specific personal web page guidelines:
The purpose of this product is for personal publishing only.
- You may not sell space or lease any or all of your PWP space to anyone else.
- You may not receive commissions from hyperlinks, icons, etc. to commercial sites, including embedding advertising on your page hosted by another site.
- You may not advertise products or communications services that compete with the PWP product or with any Prodigy affiliate, advertiser or product.
- You may not use your PWP to operate a business whereby you collect monies based on usage of Prodigy service features, e.g. a chat area, bbs, etc.
- You may not embed on your page graphics or elements from other sources that display such advertising. (For example, you may use your PWP to "advertise" your own web-page creation service; however, a web page hosting service would not be permitted.)
Extraordinarily heavy usage of a site may interfere with the overall performance of the PWP product. In order to facilitate access by all users, if members and/or other users access the distinct elements of your page more than 25,000 times a day, Prodigy may discontinue hosting the page. The counter will be reset at midnight EST each day.
In addition to activities prohibited by the Interactive Features Guidelines, you agree not to use your PWP to:
- Promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, but is not limited to, providing instructions on how to assemble bombs, grenades, and other weapons;
- Intentionally or unintentionally violate any applicable local, state, national, or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any or other securities exchange, and any regulations having the force of law;
- Use your home page or directory as storage for remote loading or as a door or signpost to another home page;
- Upload, post, or otherwise transmit any Content that you do not have a right to transmit under any law or contractual or fiduciary relationship, including inside information, proprietary or confidential information.
- Upload, post, or otherwise transmit any Content that infringes on any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party.
Content suitability ratings:
Please consider registering your site with the Internet Content Rating Association (ICRA). This organization provides Web surfers with information about the suitability of Internet content for themselves and their families. If you do not register your site or your site does not fit the categories selected by certain visitors who use the ICRA product on their computers in conjunction with the Microsoft Internet Explorer browser, those visitors will not be able to access your site.
Access control:
If you are concerned about the suitability for children of certain content contained in your PWP, select "Access Control" so that you can block access to those PWPs you deem inappropriate.
Alerts:
Send us an alert (this will link to our alert form) if you spot a PWP that you believe violates our Guidelines.
