Current:  Attorney-at-Law presently a solo-practitioner primarily engaged in complex civil litigation and Trial and Appeals Court Practice.  Also, past experience in criminal law. Admitted to practice in the State and Federal Courts of Illinois since 1982; and admitted practice before the U.S. Court of Appeals for the Seventh Circuit and the U.S. Supreme Court Bar.  Mr. Morton is also a State Hearing Officer for the IL. Dept. of Education and an Arbitrator accredited by numerous National and International Dispute Resolution Organizations (Private Judge) -- see detail below.

Campaign News:    Judgeship Lost by only 1 Vote (Twice)?

A Petition Challenge and Objection to the nominating Petitions of Judge Mary S. Schostok was filed with the Illinois State Board of Elections on behalf of Robert B. Morton by Nancy P. Morton, then Successor Chairwoman of the Morton for Judge Committee.  The Objection to Schostok's nominating Petitions claimed that her Petitions unlawfully (and repeatedly) used Schostok's official "title" as a sitting Judge, in clear violation of the Illinois Election Code, 10 ILCS 5/7-10.2.   Prior well-settled legal precedent clearly mandated her removal from the ballot for violation of this provision of the election code, due to the inherent taint of undue influence from the use of official titles on petitions.  See:  Jones v. Electoral Bd., 112 Ill.App.3d 926, 446 N.E.2d 256 (1983).   Since Schostok was Morton's only opponent for this contested judicial vacancy, a ruling upholding the Petition challenge would effectively result in Morton's election as Circuit Judge.   On January 22, 2002, after hearing arguments on the Objection to Schostok's nominating petitions, the Illinois State Board of Elections stalemated in a 4-4 Tie Vote (Case No. 01 SEBGP 511).  Morton filed an appeal in the Circuit Court for Sangamon County in Springfield, Illinois (Case No. 02 MR 44).  On February 6, 2002, the Hon. Circuit Judge Leslie Graves, correctly followed legal precedent by ruling in favor of Morton's Objection, holding that Schostok's violation had forfeited her candidacy and Ordering the State Board of Elections to remove Schostok's name from the Primary Election ballot.   Schostok then appealed, and after expedited review on February 22, 2002, in an unpublished ruling the 4th District Appellate Court reversed, ignoring the prior well-settled legal precedent and allowing Schostok back on the primary ballot (Case No. 4-02-0119).   The Illinois Supreme Court then granted a rare emergency appeal filed by Morton.  Oral arguments were scheduled for March 12, 2002, only a week prior to the Primary election.  Justice Robert Thomas properly recused himself because he had recommended the Supreme Court's temporary appointment of Schostok to fill a judicial vacancy on the Lake County Circuit Court.  Morton argued his own case before the High Court.  The final chapter came only an hour after oral arguments, when it was perfunctorily announced in a brief written Order that the Illinois Supreme Court itself had now deadlocked in a 3-3 Tie Vote and thus was constitutionally unable to reach a majority decision, thereby narrowly permitting Schostok to remain on the Primary ballot despite her obvious folly (Docket No. 93330).  QUERRY:  If Schostok had not been a sitting Judge appointed by the very same Supreme Court deciding her fate, would the result have been the same?     "You be the Judge!"

(former Mayor of Fox Lake, former President of the Grant Township Republican Club, former Chairman of the Fox Waterway Agency, and current Illinois Republic Central Committeeman ).    Late in the campaign he was succeeded by Nancy P. Morton, as Chairwoman of the Morton for Judge Committee.
