Hinchey W. Warren
was born June 8, 1787* Burke Co., Ga. and removed to Conecuh Co, Ala about
1818, settling near his father, E/S Murder Creek, 1 mi. E. of Sparta, where
he died on February 28, 1855 (Obit** & grave marker) and is buried
in a private family cemetery on his old plantation. (Warren Family Cemetery)

"Departed this life on Wednesday morning, the 28th ultimo, at his residence in Conecuh County, Ala., HINCHEY WARREN, ESQ. in the 68th year of his age. Mr. Warren was one of the first settlers in the county, a man of untiring energy, industry, and perseverance-eminently successful as a planter and agriculturist; and accumulated a handsome fortune by his own industry. He was a man of strict integrity, punctual in all his business transactions and in the true sense of the term an honest man. He was an affectionate husband, a kind parent, and a warm and faithful friend--kind and courteous in his intercourse with society, modest and retiring in disposition. "
"In the death of Mr. Warren the community has sustained a severe loss, his family and intimate friends one that is irreparable--a glorious consolation remains; he died resigned to the will of his heavenly Father, and with a firm hope of a happy immortality."

At one time it had a very ornate iron fence around it, but now it is laying flat on the ground. It had recently been cleaned of underbrush and mowed.* The large flat marble slabs are laying flat on the ground now-They appear to have been the top section of marble tombs which have been opened either by time or vandals. (*This was the culmination of two years of work by Warren descendants Clyde Warren Boulware & daughter Claire Boulware Stallworth, whose work to restore the cemetery continues. 16 June '02).
The marker for Mary M. Warren, wife of H. W. Warren and Amanda N. Boulware is all on one smaller marble marker-Amanda Boulware on left side and Mary M. Warren on right side- with a picture of a pair of clasped hands at the top. There is also an adult size marble tomb with no marking of any kind on it, as well as at least 12-15 other graves there, some with only rocks marking the spot and some with nothing marking the spot, only sink holes indicating graves.- Personal visit, Wednesday, Nov. 15, 2000-SGS.
Marker Reads: "This marble is dedicated
to the memory of Hinchey Warren, a native of Georgia, who departed this
life February 28th, 1855 in the 68th year of his age
Being possessed of great energy and a strong
intellect, he was imminently successful in business.
For several years before his death he was an
active and pious member of the Beulah Baptist Church and was supported
amidst the terrors of death by the consolations of the Gospel.
A few only of his children have been spared to
execute this act of devotion, this last tribute of respect to his departed
remains.
In memory of his exe____ied virtues, being sensible
of the irreparable loss they have sustained and while gratitude remains
on earth, his affectionate children will never cease to lament a
good father and husband."

P 305-"In 1829 Hinchey (Hinchea) Warren
entered land in plots scattered over the southwest area of Barbour Co,
but it is doubtful if he lived on any of them. There was a Hinch
Warren living in Conecuh Co, Ala. in 1818; also Richard, Malakiah, Robert
and Ketral Warren. On Aug. 14, 1837, Hinchey Warren and wife,
Mary H., of Conecuh Co, Ala, sold part of their land in Barbour
Co. to Jared Williams, so it is probable that he stayed in Conecuh
Co. If he was related to Thomas Warren, it is not shown in
the records.
There was a Hinch Warren living in Burke Co, Ga. at the time of the 1805 Land Lottery. "

This indenture made and entered into the 8th of April, 1846, between HINCHEY WARREN of the County of Conecuh and State aforesaid, the party of the first part and MALACHI WARREN of the County of Lowndes and State aforesaid, the party of the second part, Witnesseth; That whereas the said party of the first part is desirous of providing for the maintenance and support of his daughter SARAH A. GREENING, wife of JOHN J. GREENING, of the County of Dallas and State aforesaid, and keep her, his daughter, free from want as in duty and affection he is bound to do; now the said party of the first part for and in consideration of the promises and for the further consideration of the sum of one dollar to him in hand paid by the party of the second part, the receipt whereof is hereby acknowledged, doth hereby give, grant, bargain, and sell, the following described property, Viz:
Three mules, one horse, one mare, one wagon and gear, all plantation tools, seventeen head of cattle, fifteen head of hogs, four hundred bushels of corn, eight stacks fodder, household furniture, one metal clock, two beds and bedsteads, one (illeg.) one thousand lbs. Bacon;
Also the following Negro slaves, Viz:
Bob (Aleat) Bob, ferryman, Charlotte, Archibald, Peyton, Peggy, Aslony, John, Charles, Major, Eliza, Sue, Suvannah, Juliet, Ainey, Kitty and Polly, to have and to hold to him the party of the second part, his heirs, Executors, and Administrators forever. In full trust and confidence, however, and it upon the express condition that he the said party of the second part, will forever and during the natural life of the said SARAH A. GREENING to have the use and benefit and to receive the rents and profits of all the above mentioned property for the support of herself and family and he the said party of the second part to take the said property into his possession for and during the natural life of the said SARAH A. GREENING to have the same in possession of her the said SARAH A. GREENING as in his discretion he shall see fit, but to be free from any control of her said husband JOHN J. GREENING, and from and after the death of the said SARAH A. GREENING to convey the said property to the Heirs of the body of the said SARAH A. GREENING of her body begotten by her present and any future husband whom she may marry, living at the time of such conveyance, provided however, that should any of the heirs of the body of the said SARAH A. GREENING die before such conveyance leaving heirs of his or her body then the said party of the second part shall convey to the heirs of the body of such descendent or such portion of said property, as would have been his or her portion had he or she been living at the time of such conveyance and provide further that the said party of the second part may at any time when he may deem it to be for the interest of the said SARAH A. GREENING sell all or any portion of the said property and the proceeds of the sale vest in other property upon the same trust as are herein provided for. And, the party of the second part do hereby covenant and agree with the said party of the first part he will and truly do and perform all of the conditions upon him empowered by the above and in witness whereof the parties of the first part and the second part have set their hands and affixed their seals on the day and year above written.

This indenture made this twenty-fifth day of February, in the year of our Lord, One Thousand Eight Hundred and Forty-Seven, between HINCHEY WARREN of the County of Conecuh and State of Alabama, of the first part, and SARAH A. GREENING, and JOHN J. GREENING, Husband of said Sarah, of the State of Louisiana, DeSoto Parish, of the second part, witnesseth that the said HINCHEY WARREN, party of the first part aforesaid for and in consideration of the natural love and affection which he has and beareth to his daughter, the said SARAH A. GREENING, as well as for the further consideration of one dollar in hand paid by JOHN J. GREENING, Trustee, as aforesaid the receipt whereof is hereby acknowledged by the said party of the first part at and before the sealing and delivering of these presents and also for divers good considerations he hereunto moving does give, grant, sell and convey to the said SARAH A. GREENING and JOHN J. GREENING, as Trustee of said Sarah, the following named and described Negro property, to wit:
Sarah, a Negro slave aged about forty years old,
Dick, a slave aged twelve years, Margaret, aged about twenty-four years,
and her infant child Cloe, to have and to hold the same to the said JOHN
J. GREENING, Trustee as aforesaid, together with the future increase of
the same for the express use, benefit and behoof of the said SARAH A. GREENING,
to be used and worked by him for the comfort and support of the said SARAH
as he may think expedient and right and in no case to be used or worked
or hired except for and under such considerations for and during the natural
life of her the said SARAH and at her death to have said property registered
in orphans court or the Court conducting the Estates of deceased persons
wherever he the said JOHN and SARAH might there reside, as the property
of the legal heirs of the body of said SARAH and be used, worked or hired
by him for the same and under the same considerations for the children
of said SARAH as if they were living and the said party of the first part
hereby vesting said Trustee with full and ample authority to do and perform
every act that he may at any time think advantageous to the said SARAH
or the lawful heirs of her body by sale or otherwise at all times applying
the proceeds thereof to the use and uses herein before mentioned.

Greening is defendant that said witnesses having appeared before me and duly sworn and examined and their answers written down by me, and signed by said witnesses, and I herewith return the same, together with the commission and interrogatories to the court from whence they originated..

On and by the authority in me vested by virtue
of a commission to me directed from the Clerk of the District Court of
DeSoto Parish, State of Louisiana, dated the 29th day of January, Eighteen
Hundred and Sixty-Seven, to take the testimony of A. D. Cary, Amanda N.
Boulware, and John M. Henderson, in a certain case in said Court pending
in which SARAH A. GREENING is Plaintiff and John J. Greening is defendant,
the said A. D. Cary being duly examined and sworn, to the first interrogatory
he answered as follows: "I was formerly Judge of the Court of Probate of
Conecuh and was Judge from the first of May, Eighteen Hundred and Fifty
to the first of May, Eighteen Hundred and Sixty-Five.
Answer to Int. 2nd, He says, upon examination
of the transcript annexed to interrogations, He finds that it is a transcript
of the original settlement of the Estate of HINCHEY WARREN, Deceased, by
Mortimer Boulware; that said transcript was made out by himself, and that
the original with all papers and records relative to said Estate were burned
by the burning of the Courthouse on the l0th of November last.
Answer to Int. 3rd: He says that upon examination
of the transcript he finds the distributive share of each heir to have
been the sum of Twenty-Six Thousand Four Hundred and Eighteen dollars and
16 2/3 cents, at the time as shown in said transcript, to-wit: the 17th
day of March, 1858, which said transcript was given on the 12th of April,
1858, as shown by him.
Answer to Int. 4th: He answers that of his own
knowledge he does not know of the payment of said distributive share referred
to in the interrogation, but he recollects distinctly that he recorded
a receipt in the Probate Court from JOHN J. GREENING to MORTIMER BOULWARE,
Executor of the last will of HINCHEY WARREN, deceased, in full of the distributive
share of said SARAH A. GREENING- I also recollect seeing several receipts
which were given by JOHN J. GREENING in part payment of the distributive
share of SARAH A. GREENING but the last receipt covers the whole amount-
and deponent will state further that he believes said JOHN J. GREENING
did receive said distributive share -and further this deponent says that
the Court of Probate is the Court of Record in our State of all Estate
Matters.

to the first interrogation, she answers as follows:
She answers that she knows of her own personal
knowledge from information from her former husband the said MORTIMER BOULWARE
who was the Executor of the last Will and Testament of said HINCHEY WARREN
that the amount shown to be the distributive share of SARAH A. GREENING,
on said final settlement as shown in the transcript annexed to the interrogations,
to-Wit: the sum of Twenty-Six Thousand Four Hundred and Eighteen 16 2/3
dollars, was paid to JOHN J. GREENING.
Answer to Int. 2nd: She answers that upon an
examination of the papers now in her possession belonging to her late husband,
MORTIMER BOULWARE, she finds a receipt from said JOHN J. GREENING to her
husband said MORTIMER BOULWARE for the identical amount as shown in the
transcript to be the distributive share and that said receipt bears the
endorsement of the Judge of Probate showing the same to have been properly
recorded.

Henderson, Judge of the Court of Probate in and for the County and State aforesaid, hereby certify that my said Court of Probate is the only Court in said County in which Wills and Deeds are recorded and the estates of deceased persons and minors managed and settled; that it is the only Court having jurisdiction of the persons and property of Orphans; that I am Ex-Officio the Clerk of said Court, and that the Court House at Sparta, Alabama, with every record in which Wills, Deeds, and Settlements of Estates had been recorded, with all the original papers on file in said office, were on the l0th day of November, 1866, completely destroyed by fire.

In this case, by reason of the law and the evidence being in favor of the plaintiff, SARAH A WARREN, wife of the defendant, it is therefore ordered, adjudged and decreed that she recover of and from the defendant JOHN J. GREENING, the Sum of Twenty-Six Thousand Four Hundred and Eighteen dollars and Sixteen 2/3 cents with five per cent per annum interest thereon from the 8th day of December, A. D., One Thousand Eight Hundred and Sixty-Six, and all costs of this suit.
It is further ordered, adjudged and decreed that
her tacit mortgages on the lands described in her petition in this case
be recognized and enforced, taking date from 17th March, 1858. That the
community of acquits and gains between her and her said husband be dissolved,
and that she have the separate administration and control of her Estate.
This done and signed in open court this 14th
