Employment of Aliens (8 U.S.C. §1324a)

• It is illegal to knowingly hire or recruit aliens who have not been lawfully admitted in the U.S. or who are not authorized to work in the U.S.

• An employer must swear that it has verified that each individual being hired is not an unauthorized alien.

• An employer must also have applicants sign a special form swearing that they are either citizens or nationals of the United States, lawful permanent residents, or aliens authorized to work. This is called an I-9 form.

• Employers cannot discriminate against legal aliens.
