Terms and Conditions
TMS, Inc Menagerie Collection™ merchandise is
considered to be decorative in nature and should be used in that capacity.
First Order Minimum:
$200.00 net or Pre-Pay
Re-Order Minimum:
No Minimum
Delivery Time:
Most orders ship within two weeks.
Conditions:
TMS inc is not responsible for printing or typographical errors. TMS inc
reserves the right to discontinue product or change prices without notice.
All merchandise is considered decorative in nature unless otherwise stated,
and should be used in that capacity.
Shipping Terms:
All shipments are F.O.B. warehouse. TMS, Inc. will ship U.P.S. when
possible; otherwise merchandise will be shipped via approved truck line. On
consolidated orders, TMS, Inc. will contact the customer for a preferred
carrier. Some orders are not U.P.S shippable. TMS inc will ship these on a
common carrier. Some of TMS inc’s merchandise is considered oversized in
nature and will naturally accrue a higher shipping charge.
Payment Terms:
TMS, Inc. does not ship C.O.D. For net/30 terms, applicants must submit a
credit application with a minimum of three credit references. Credit
approved customers will receive net 30 day terms on any REORDERS (first
order may be prepaid or credit card for expedited shipping). It takes
approximately three weeks to check credit references. TMS, Inc. accepts
payment by Master Card, Visa, American Express, and Discover. Credit cards
are charged the day the order ships. Please submit the card number, name as
it appears on the card, and expiration date. At its discretion, TMS inc may
refuse shipment to a customer.
Claims:
All damage or shortage claims must be reported to TMS, Inc. within 10 (ten)
days of receipt of shipment. It is the customers’ responsibility to inspect
all boxes within 10 days of receipt of shipment. Original packing materials
must be kept for the carriers’ inspection. TMS, Inc. will not be responsible
for processing claims unless these instructions are followed.
Replacements:
Upon the customer’s request, replacements will be treated as a new order.
TMS inc, at its discretion may opt to give the customer a credit instead of
a replacement.
Returns:
Returns will not be accepted unless pre-authorized by TMS, Inc. home office.
Return requests must be submitted in writing and mailed or faxed directly to
TMS, Inc. Customers must include a copy of the invoice, quantity and reason
for the requested return. Returns will not be authorized that are over 30
days from invoice. If approved, a return goods authorization number (RA)
will be issued. This RA number must accompany the returned order. Deductions
from invoices for damages, defective merchandise or shortages will not be
accepted without prior written authorization from TMS, Inc. Refused
shipments are not allowed by TMS inc.
Re-Stocking Fee:
A 15% re-stocking charge will be applied on all approved returns. Any
exceptions will be made at the discretion of TMS, Inc.
Hand Crafted Merchandise:
All of the merchandise offered by TMS, Inc. is hand made and hand crafted.
Slight variations in the size, color and appearance should be considered a
natural characteristic of hand crafted merchandise. TMS, Inc merchandise is
considered to be decorative in nature and should be used in that capacity.
Warranties are not offered.
Natural Bamboo Merchandise:
Please note that our bamboo poles are made from natural bamboo. No two poles
are identical. Organic pits, curves, or splits in the wood are natural in
the poles and are not considered defects.
